This is a translation of the Spanish original, provided for convenience. In the event of any discrepancy between language versions, the Spanish version prevails (see section 14.4).

Yeshcube Tech, S.L. develops emotional wellbeing technologies, including mobile applications, artificial intelligence systems for immersive experiences and technological devices related to emotional wellbeing.
2. Scope and Application
2.1 Services covered
These Terms and Conditions govern access to and use of the following services provided by Yeshcube Tech, S.L.:
- Corporate website: https://yeshcube.com
- “yesh app” mobile application for emotional wellbeing
- Somia system: Artificial intelligence for emotional experiences
- Immersive experiences through:
- Interactive web sessions
- Immersive booths
- VVAVVE™ sensory devices
- Any other authorized physical or digital interface
- Technology consultancy services related to emotional wellbeing
2.2 Nature of the services
IMPORTANT: All our services are designed exclusively for general wellbeing and entertainment purposes. They do not constitute medical, therapeutic, psychological or diagnostic services. For any mental or emotional health issue, you should consult qualified healthcare professionals.
3. Acceptance of the Terms and Conditions
3.1 Consent
Accessing and/or using any of our services implies express and full acceptance of these Terms and Conditions of Use, as well as our Privacy Policy and Cookie Policy.
3.2 Legal capacity
To use our services, the user must:
- Be at least 14 years old
- Have legal capacity to contract under Spanish law
- If under 18, have the express authorization of their parents or legal guardians
Procedure for minors (14–17 years):
- The minor must obtain written parental consent
- Parents/guardians must verify and supervise the use of the services
- We reserve the right to request verification of parental consent
- Parents/guardians will be responsible for the minor’s activity on our services
3.3 Modifications
We reserve the right to modify these terms at any time. Modifications will be notified through:

- Email notification (for substantial changes)
- A notice in the mobile application
Continued use of the services after notification implies acceptance of the modifications.
4. Conditions of Access and Use
4.1 Technical requirements

4.2 User obligations
The user undertakes to:

- Not interfere with the normal operation of the system

All the content of the website, application and devices (including but not limited to texts, graphics, logos, icons, images, audio clips, digital downloads, data compilations and software) is the property of Yeshcube Tech, S.L. or its licensors and is protected by:
- Copyright and related rights
- Trademark rights
- Industrial design rights
- Trade secrets
- Other intellectual and industrial property laws
6.2 License of use
Users are granted a limited, non-exclusive, non-transferable and revocable license to:
- Access and use the services for personal, non-commercial purposes
- Download and use the mobile application on authorized devices
- View content on screen
6.3 Restrictions
The following are expressly prohibited:
- Reproducing, copying, distributing or transmitting any content
- Modifying, decompiling or reverse engineering
- Creating derivative works
- Using content for commercial purposes without written authorization
- Removing intellectual property notices
7. Use of the Somia System and Emotional Experiences
7.1 Service description
Somia is an artificial intelligence system designed to provide non-clinical emotional experiences through:
- Guided relaxation and mindfulness sessions
- Personalized immersive experiences
- Emotional self-regulation tools
- Educational content about wellbeing
7.2 Limitations and medical disclaimer
IMPORTANT – MEDICAL DISCLAIMER:
- Somia is NOT a therapeutic, diagnostic or medical tool
- It does not replace professional medical advice
- It must not be used to treat mental health disorders
- Interactions are designed solely for relaxation and general wellbeing
- For mental health problems, consult qualified professionals
7.3 Biometric and sensitive data
In certain optional experiences, we may process biometric or emotional wellbeing data:
- It is only collected with your express, specific consent
- Only when specialized devices are used (biometric rings, optional sensors)
- This data is processed exclusively to personalize the experience
- You can withdraw your consent at any time
- The data is stored with maximum security measures
- It is not shared with third parties without additional authorization
7.4 Responsible use
The user acknowledges and agrees that they will:
- Use the experiences in a safe environment
- Stop using them if they feel any discomfort
- Not use the services under the influence of substances
- Consult medical professionals if they have pre-existing conditions
8. Commercial and Contractual Conditions
8.1 Service options
We offer the following options:
- Free services: Basic access to the application and limited experiences
- Premium subscriptions: Full access to all features via a monthly or annual subscription
- Physical products: VVAVVE™ devices and related hardware (coming soon)
- Corporate services: Tailored solutions for companies
8.2 Prices and billing
- All prices include VAT where applicable
- Subscription prices are charged recurrently according to the option chosen
- We reserve the right to change prices with 30 days’ notice
- Subscription billing is automatic until cancellation
- Physical products are billed once the order is confirmed
8.3 Subscriptions
How they work:
- Subscriptions renew automatically
- Charges are made on the date corresponding to the billing cycle
- You can cancel your subscription at any time from the application
- Cancellation takes effect at the end of the current billing period
Trial period:
- We may offer free trial periods for new users
- The length of the trial period will be specified in the offer
- When the trial period ends, the paid subscription starts automatically
- You can cancel during the trial period free of charge
8.4 Payment methods
We accept the following payment methods:
- Credit and debit cards (Visa, Mastercard)
- PayPal
- Bank transfer (for corporate services)
- Other authorized methods
8.5 Right of withdrawal
In accordance with consumer protection legislation, you have the right to withdraw from the contract within 14 calendar days of contracting, without justification and without penalty.

- Include the identifying details of the contract
8.6 Refunds
- Refunds will be processed within a maximum of 14 days
- They will be made using the same payment method used

10.2 Exclusion of liability
Yeshcube Tech, S.L. shall not be liable for:
- Indirect or consequential damages or loss of profit
- Loss of data or information
- Decisions taken on the basis of Somia’s suggestions
- Technical problems, incompatibilities or interruptions
- Acts of third parties or force majeure
- Improper use of the services by the user
10.3 Liability caps
In any case, our total liability shall be limited to the amount actually paid by the user in the 12 months prior to the event causing the damage.
11. Force Majeure
We shall not be liable for failing to perform our obligations due to force majeure, including but not limited to:
- Natural disasters
- Acts of public authorities
- Labor disputes
- Telecommunications infrastructure failures
- Cyberattacks or IT security problems
- Pandemics or health emergencies

13. Governing Law and Jurisdiction
13.1 Governing law
These Terms and Conditions are governed by Spanish law, in particular:
- Law 34/2002 on Information Society Services and Electronic Commerce
- The Spanish Civil Code
- The General Law for the Defense of Consumers and Users
- General Data Protection Regulation (EU) 2016/679
- Organic Law 3/2018 on Data Protection
13.2 Jurisdiction
For the resolution of any dispute, the parties submit to the jurisdiction of the Courts of Valencia, Spain, expressly waiving any other jurisdiction that might apply.
13.3 Consumers
If you are a consumer, nothing in these terms affects your statutory rights as a consumer under applicable law.
14. Final Provisions
14.1 Entire agreement
These Terms and Conditions, together with the Privacy Policy and the Cookie Policy, constitute the entire agreement between the parties.
14.2 Partial invalidity
If any provision of these terms is declared void or unenforceable, the remainder of the document shall remain valid and effective.
14.3 Waiver
Failure to exercise any right shall not constitute a waiver of that right.
14.4 Languages
In the event of any discrepancy between versions in different languages, the Spanish version shall prevail.
